Pre-Trial (DUI) Limited Driving Privilege

The DMV will suspend the driver’s license for 30 days following the DWI arrest if the driver blew 0.08 or greater on the breath test at the police station or if the driver did not provide two valid breath samples. On the 11th day following the drivers arrest, I can obtain a pre-trial limited driving privilege by presenting a petition, a certified driving record, a substance abuse assessment, a “DL123” insurance form as proof of insurance and paying a $100 filing fee. On the 31st day following the driver’s arrest, I can pay the $100 civil revocation fee, the court will return the driver’s license card, and the driver may resume driving immediately. The driver’s license will remain suspended indefinitely until this $100 civil revocation fee is paid.
