Limited Driving Privileges If Willful Refusal
If the driver did not provide two valid breath samples at the police station, the DMV will send the driver a letter stating that his license is going to be suspended for 1 year for willfully refusing to blow. The driver must appeal this notice within 10 days from the time the DMV mailed it. In these cases, I check the DMV weekly to insure that we don’t miss this appeal deadline. Otherwise, this 1-year suspension becomes permanent. If the driver’s license is suspended for willful refusal to provide two valid breath samples, the driver may be eligible for a limited privilege 6 months after this suspension begins.
