For DWI, Operating a motor vehicle on a public vehicular area while appreciably impaired by an “IMPAIRING SUBSTANCE.”
An impairing substance includes alcohol, prescription drugs, illegal drugs and over the counter medication. A driver may be convicted of DWI for taking prescription medication exactly as prescribed if it causes appreciable impairment.
When an officer suspects non-alcohol impairment, he may request a blood sample for testing. Refusing the breath test or blood test at the police station means the DMV will suspend the driver’s license for 12 months even if the driver is found not guilty of DWI.
