“Reasonable Suspicion” Motion to Suppress & Dismiss.

The officer must have a good reason (reasonable suspicion) to believe the driver committed a traffic violation or the driving was unsafe indicating the driver may have had a medical problem like a heart attack, stroke, or impairment.  We always request a copy of the officer’s dash camera video.  Often, the officer exaggerates by saying the driving was worse than the video shows.

We Will Challenge The Officer’s Lack of Evidence  and Violations of Law and Procedure

We can introduce this video at trial to show the driving was safe and ask the court to suppress all evidence because the officer stopped the driver without reasonable suspicion. When the court suppresses the evidence, the prosecutor must dismiss the case.
